H.R. 5340 — To prohibit the disclosure of records by the Secretary of Housing and Urban Development of individuals for the purposes of immigration enforcement, and for other purposes.

This section prohibits the Secretary of Housing and Urban Development (HUD) from disclosing, for immigration enforcement purposes (i.e., law enforcement actions under 8 U.S.C. for alleged immigration violations), any record in a HUD system of records (i.e., retrievable by individual name or identifier) to any person or agency without a written request in a language of proficiency by, or prior consent of, the individual to whom the record pertains, regardless of immigration status. The section further prohibits HUD from compelling a public housing agency (PHA)—as defined in section 3(b) of the United States Housing Act of 1937—to disclose such records. Additionally, the section requires HUD to submit a report to Congress within 90 days of enactment that includes (1) a compliance timeline, (2) confirmation that covered records have been secured, (3) a description of prior sharing of such records, and (4) a description of future compliance measures.
