H.R. 5354 — Equal Employment for All Act of 2025

This section prohibits persons, including prospective or current employers, from using or procuring a consumer report or investigative consumer report containing any information on a consumer's creditworthiness, credit standing, or credit capacity for employment purposes or adverse actions (as described in FCRA Section 603(k)(1)(B)(ii)), regardless of consumer consent. Exceptions permit such use only for employment requiring national security clearance or as otherwise required by law, without affecting other FCRA disclosure and notification requirements. (Thus, consumer reporting agencies generally may not furnish credit-bearing consumer reports to employers seeking them for employment decisions, including denials; limited exceptions require consumer authorization and apply only to jobs needing access to classified information or as required by law.) The section makes conforming amendments to FCRA cross-references and updates authorization and conditions for furnishing reports for employment purposes.
