H.R. 5359 — No Bribes for Politicians Act of 2025

This section prohibits the use of tangible gifts of more than minimal value deposited with an agency for official use in conjunction with Presidential duties and requires the agency to promptly dispose of such gifts in accordance with 5 U.S.C. 7342(e). (Thus, under the Foreign Gifts and Decorations Act, such gifts—typically from foreign governments or officials—cannot be retained or utilized by the President or executive branch personnel in official capacities.)

This section revises the financial disclosure reporting requirement for certain officers and employees (i.e., those described in 5 U.S.C. 13103(f)) to biannual reports beginning in calendar year 2026, replacing the prior annual requirement. It requires a report covering January 1-June 30 (due October 15 of that year) and July 1-December 31 (due May 15 of the succeeding year) if the individual performs duties for more than 60 days in the period, with information from 5 U.S.C. 13104(a) applied to the applicable 6-month period (instead of the preceding calendar year).

This section expands financial disclosure requirements in periodic transaction reports to include specified relatives of the President, Vice President, and Cabinet secretaries—defined as parents, children, siblings, spouses, in-laws, uncles, aunts, first cousins, nephews, nieces, and step- and half-relations (previously limited to spouses and dependent children). It makes conforming changes to report headings and the scope of spouse and dependent child disclosures.

This section establishes prohibitions on business activities of the President and Vice President—(1) barring any financial interest in a for-profit entity and requiring divestiture to cash within 30 days of assuming office; (2) barring the President or Vice President, or their spouse or dependent child, from using the President's or Vice President's name or likeness for profit or permitting such use by any for-profit entity; (3) barring service as an officer, board member, or other decision-making role at any for-profit entity (excluding interests in retirement accounts, including government employee plans)—and amends the civil enforcement provision to authorize the Attorney General to bring actions and assess penalties of not more than $10,000 or the compensation received for the prohibited conduct (whichever greater) for violations of these prohibitions as well as existing restrictions (to "section 13143, 13144, or 13147" from "section 13143 or 13144").
