This section establishes in title 23, United States Code, a requirement for the Secretary of Transportation to withhold 10% of a state's apportionments under the National Highway Performance Program (NHPP) and Surface Transportation Block Grant Program (STBG)—the core formula funding programs for highway construction and maintenance—beginning October 1, 2026 (FY2027), if the state's governor fails to certify annually that no jurisdiction operates an automated speed enforcement system (i.e., a device that captures vehicle images to issue speed citations without a law enforcement officer present). States may operate such systems in designated school zones during posted school hours or active construction work zones for the project's duration, provided the location's posted speed limit is under 55 miles per hour when not active and clear signage indicates the construction zone and enforcement system. The Secretary may audit certifications, issue implementing regulations, and the provision includes a conforming amendment to the chapter table of contents.
