H.R. 5462 — Michelle Alyssa Go Act

This section revises the definition of "institution for mental diseases" (IMD) under Medicaid to exclude any hospital, nursing facility, or other institution primarily engaged in diagnosis, treatment, or care of persons with mental diseases that (1) has 36 beds or less and (2) meets Secretary of Health and Human Services-approved, nationally recognized, evidence-based standards for mental health programs (and, for substance use disorder treatment, such standards as those of the American Society of Addiction Medicine), including requirements for types of services offered, hours of clinical care, and staffing credentials. (As background, federal Medicaid matching funds are generally prohibited for services to individuals ages 21-64 provided in IMDs, known as the IMD exclusion; thus, qualifying small facilities would become eligible for such funds.)
