H.R. 5464 — Net Metering Protection Act

This section prohibits any commission, board, or other entity established by Congress from prohibiting or obstructing a State regulatory authority or nonregulated electric utility from implementing or enforcing the net metering service standard under section 111(d)(11) of the Public Utility Regulatory Policies Act of 1978 (16 U.S.C. 2621(d)(11)), if the authority or utility determines implementation appropriate, notwithstanding any other provision of law. The section applies the definitions of “nonregulated electric utility” (i.e., any electric utility other than a State-regulated electric utility) and “State regulatory authority” from section 3 of that Act (16 U.S.C. 2602).
