This section establishes the President’s Council on Sports, Fitness, and Nutrition as an advisory body to the President, consisting of up to 30 members appointed by the President to 2-year terms (eligible for reappointment and continuing until a successor is appointed), with the President designating a Chair and Vice Chair. The Council must advise the President on progress made under this section and recommend actions including (1) strategies to reestablish the Presidential Fitness Test as the main assessment for a Presidential Fitness Award; (2) development and promotion of Presidential challenges and school-based physical education programs; (3) expansion of sports and fitness opportunities at all levels; (4) innovative fitness goals for youth; (5) campaigns elevating sports, military readiness, and health; (6) partnerships to promote active lifestyles and nutrition; and (7) strategies addressing childhood obesity, chronic diseases, and sedentary lifestyles as national security threats. For administration, executive agencies must furnish requested information and assistance; members serve without compensation but receive travel reimbursement; the Secretary of Health and Human Services provides funding and support subject to appropriations; the Council may establish subcommittees with presidential approval and must modify the prior seal of the President’s Council on Physical Fitness and Sports; and the Federal Advisory Committee Act applies with the Secretary performing certain presidential functions. The Council terminates 2 years after enactment unless extended by the President.
