H.R. 5502 — AirFAIR Act

This section designates as an unfair or deceptive practice under DOT enforcement authority (49 U.S.C. 41712) the imposition of excessive increases in air transportation ticket prices by air carriers, foreign air carriers, ticket agents, or other sellers in circumstances related to a disaster or emergency declared by a State, the District of Columbia, or a U.S. territory or possession. It directs the Secretary of Transportation to issue regulations establishing standards for excessive increases, treating at least a 30% increase as excessive. Separately, it requires the FAA Administrator to study unfair ticket pricing practices during such disasters or emergencies and submit a report to Congress within one year of enactment.
