H.R. 5514 — POJA Act of 2025

This section revises employer prohibitions under the Age Discrimination in Employment Act of 1967 (ADEA) to bar limiting, segregating, or classifying applicants for employment (in addition to employees) in any way that deprives or tends to deprive any individual of employment opportunities or adversely affects status as an employee or applicant for employment, because of such individual's age. (The ADEA generally prohibits age discrimination in employment against individuals age 40 and older; thus, this change explicitly extends such protections to job applicants.)

This section directs the Equal Employment Opportunity Commission (EEOC) to conduct a study, due not later than one year after enactment, determining the number of claims pending or filed with the Commission since 2015 under the Age Discrimination in Employment Act of 1967—including closed cases—by job applicants alleging age discrimination in the hiring process. The EEOC Chairman must submit a report on the study's results, including recommendations for best practices to prevent, combat, and address such discrimination, to the House Committee on Education and Labor and the Senate Committee on Health, Education, Labor, and Pensions, and make the report publicly available.
