§3. United States Working Group on Children in Imminent Danger of Sexual Abuse and Exploitation
This section establishes a United States Working Group on Children in Imminent Danger of Sexual Abuse and Exploitation, to be created by the Attorney General not later than 90 days after enactment, to study victim-centric policing strategies and resource needs for identifying and rescuing (1) U.S. children visually depicted in child sexual abuse material (CSAM), (2) U.S. children victimized by sexual abuse from CSAM offenders, and (3) foreign children visually depicted in CSAM by U.S.-based perpetrators.
The working group must, within 30 days of establishment, solicit information from state, tribal, and local law enforcement agencies and develop (A) estimates of U.S. CSAM suspects and child victims who could be protected via suspect apprehension; (B) funding, resource, and strategy recommendations; (C) annual CSAM report estimates to law enforcement and child protective services; (D) strategies to investigate contact offenders for CSAM crimes; (E) approaches for U.S. offender apprehension re foreign victims; (F) five-year data on CSAM-related arrests, prosecutions, and unidentified victims; (G) analyses of stalled investigations; (H) prioritization guidance for Internet Crimes Against Children (ICAC) task forces, including encryption cases; (I) guidance on Attorney General responses to noncompliant technology firms on VPN data; and (J) evaluations of ICAC workloads and investigative capacities under 34 U.S.C. § 21114.
Not later than 365 days after enactment, the working group must submit a report to the Attorney General and specified congressional committees containing its findings, legislative recommendations, support received from the Attorney General, and explanations if estimates cannot be developed.
