H.R. 5540 — Justice for Exonerees Act

This section increases the maximum damages cap under the unjust conviction and imprisonment statute to $70,000 (from $50,000) per 12-month period of incarceration for non-death row plaintiffs and requires annual inflation adjustments to all caps under that subsection based on the Consumer Price Index. (As background, the statute authorizes the U.S. Court of Federal Claims to compensate individuals whose convictions are reversed on grounds of innocence or who receive pardons on such grounds, provided they did not by misconduct cause their prosecution.)
