H.R. 5564 — To amend the Federal Insecticide, Fungicide, and Rodenticide Act to provide for improved coordination between the Administrator of the Environmental Protection Agency and the Secretary of Agriculture, and for other purposes.

This section establishes coordination requirements between the EPA Administrator and the Secretary of Agriculture under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) as follows: (1) for developing risk mitigation measures for registered pesticides, including publication of an economic analysis of implementation costs to growers and others and of pesticide costs and benefits (including user risk reduction); (2) for using agronomic data from USDA and industry, plus alternatives information, in pesticide registrations, registration reviews, and related food tolerance decisions under FFDCA s.408, with docket publication of the Administrator's use or non-use of such data; and (3) for reviewing and selecting reasonable and prudent actions and measures from Endangered Species Act (ESA) s.7 consultations (16 U.S.C. 1536) on FIFRA actions—i.e., agency measures to avoid jeopardizing listed species or adversely modifying critical habitat—with the Secretaries of Agriculture, Interior, and Commerce, including feedback on end-user impacts. The section authorizes waiver or modification of these requirements for a specific action by agreement of the Administrator, Secretary of Agriculture, and registrant, if published in the docket.
