H.R. 5585 — Equal Detention Standards Act of 2025

This section requires that, beginning on the date of enactment, Federal Performance Based Detention Standards published by the U.S. Marshals Service apply to the operation of any immigration detention facility (i.e., where individuals are detained under the Immigration and Nationality Act) pursuant to any new or renewed agreement between the Department of Homeland Security and the operating entity, in addition to standards specified in such agreement. (Thus, these standards—which govern conditions of confinement for federal detainees, including medical care, safety, and recreation—supplement existing DHS contract requirements for affected facilities.)
