H.R. 5604 — National Guard Proper Use Act

This section amends Title 10, United States Code, to add a new section 975 prohibiting members of the Armed Forces from being ordered to perform duties under that title to enforce or support the enforcement of immigration laws (as defined in the Immigration and Nationality Act), in accordance with the Posse Comitatus Act (18 U.S.C. 1385); and amends Title 32, United States Code, to add a new section 330 imposing the same prohibition on members of the National Guard performing duties under that title. (As background, the Posse Comitatus Act generally limits the use of federal military personnel for domestic civilian law enforcement absent specific statutory authorization.)
