H.R. 5611 — Mental Health Care Provider Retention Act of 2025

This section authorizes covered individuals—those diagnosed with a mental health condition who are enrolling in or have enrolled in the Department of Veterans Affairs (VA) patient enrollment system under 38 U.S.C. 1705 and are transitioning from Department of Defense (DoD) treatment—to elect continued mental health care from their DoD provider at the same priority level as active duty Armed Forces members at that military medical treatment facility, with VA reimbursing DoD for services VA would otherwise furnish. If the DoD provider departs the facility, the individual may elect a different DoD provider there or a VA provider; if the individual relocates beyond reasonable access to the facility, treatment transitions to a VA provider. DoD providers must submit related medical records to VA for inclusion in the individual's VA electronic medical record upon transition.
