H.R. 5636 — Protect Consumers from Reallocation Costs Act of 2025

This section prohibits the EPA Administrator from reallocating to other obligated parties (i.e., refiners and importers) the renewable fuel obligations applicable to small refineries granted extensions under the Renewable Fuel Standard (RFS) small refinery exemption program. It further requires that gasoline and diesel volumes refined by such exempt small refineries be included in the nationwide total production and imports used to determine each obligated party's proportional RFS obligation. (Thus, exempt small refinery volumes expand the obligation denominator without adding to the obligated numerator, reducing the blending requirements for all parties.)
