H.R. 5678 — No Pay for Disarray Act

This section requires that, if a government shutdown is in effect on any day after the November 2026 federal general election, the annual pay rate for each Member of Congress under 2 U.S.C. 4501 be reduced by an amount equal to one day's pay under such rate multiplied by the number of 24-hour periods of the shutdown.

This section establishes a special rule for the One Hundred Nineteenth Congress (January 3, 2025–January 3, 2027) requiring the payroll administrator of each House of Congress to withhold from each Member's pay, for each pay period during a government shutdown, an amount equal to one day's pay under 2 U.S.C. 4501 multiplied by the number of 24-hour shutdown periods in that pay period and to deposit the withheld amounts in escrow. The section further directs release of all escrowed amounts to Members on the last day of the 119th Congress (except for shutdown days after the November 2026 general election); requires the Secretary of the Treasury to assist the payroll administrators; and defines "payroll administrator." (Thus, the rule delays but does not reduce Members' compensation, avoiding violation of the 27th Amendment.)

This section defines a Government shutdown, for purposes of this Act, as a lapse in appropriations for any federal agency or department resulting from the failure to enact a regular appropriations bill or continuing resolution.

This section defines the term "Member of Congress" for purposes of this Act to mean an individual serving in a position under 2 U.S.C. 4501(a)(1)(A)-(C) (i.e., Senators; Members of the House of Representatives; Delegates and the Resident Commissioner from Puerto Rico; the President pro tempore of the Senate and Senate majority and minority leaders; House majority and minority leaders; and the Speaker of the House of Representatives).
