H.R. 5681 — STOP HATE Act of 2025

This section requires social media companies described in subsection (f)(4) to publish, no later than 180 days after enactment, terms of service (or lack thereof) applicable to foreign terrorist organizations designated under INA §219 (8 U.S.C. 1189) and individuals or entities designated as Specially Designated Global Terrorists under EO 13224 (i.e., sanctions list administered by Treasury's OFAC); such publication must also include user contact information, flagging processes and response commitments, and a list of possible company actions (e.g., removal, demonetization, deprioritization). The section further requires these companies to submit triannual terms of service reports to the Attorney General—beginning 360 days after enactment and thereafter by January 31, April 30, and October 31—including current terms of service versions, detailed data on flagged and actioned content related to such terrorists (e.g., totals for views, shares, appeals, reversals), disaggregated by content category/type/media, flagging method (e.g., users, AI, employees), action method, and trend analysis; the Attorney General must publish all reports in a public, searchable Department of Justice website repository. It authorizes the Attorney General to seek civil penalties of up to $5 million per violation per day against any such company for (1) failing to publish terms of service, (2) failing to submit reports timely, or (3) materially omitting or misrepresenting required information. Additionally, the section directs the Director of National Intelligence to submit to Congress, no later than 360 days after enactment, a National Intelligence Estimate on terrorist use of social media platforms (with an unclassified version published on the Director's website within 30 days thereafter) and requires the Comptroller General of the United States to submit to Congress reports on this section's implementation at 540 days after enactment and again 540 days thereafter.
