H.R. 5688 — Non-Domiciled CDL Integrity Act

This section revises restrictions on states issuing commercial driver's licenses (CDLs) to non-domiciled individuals by authorizing issuance, under regulations prescribed by the Secretary of Transportation, to those domiciled in foreign jurisdictions who meet specified criteria. For applicants from foreign jurisdictions other than U.S. territories, requirements include lawful U.S. immigration status, possession of an employment-based visa, state confirmation of status before issuance/transfer/renewal/upgrade, issuance for up to 1 year or until authorized stay expires (whichever shorter), and retention of records for at least 2 years (or as prescribed by the Secretary) with provision to the Secretary within 48 hours of request. For applicants domiciled in Puerto Rico, the U.S. Virgin Islands, Guam, American Samoa, or the Commonwealth of the Northern Mariana Islands, requirements include proof and state confirmation of U.S. citizenship or lawful permanent resident status, plus the same record retention and provision rules. (CDLs are required to operate commercial motor vehicles, such as large trucks; thus, this expands the pool of eligible drivers to address potential shortages.)
