H.R. 5697 — Passenger Rail Liability Adjustment Act of 2025

This section establishes the effective date for any adjustment to the $200 million aggregate liability cap on rail passenger claims under 49 U.S.C. 28103(a)(2)—which limits total awards to all passengers against all defendants from a single accident or incident, including punitive damages only upon clear and convincing evidence of conscious, flagrant indifference to safety—as 90 days after the notice required under section 11415(b) of the FAST Act, if the adjustment occurs in calendar year 2026.
