H.R. 571 — ____ Act

This section limits eligibility for child's insurance benefits under Social Security Act §202(d) by providing that no child aged 18 or older is considered a full-time elementary or secondary school student—and thus ineligible for such benefits—for any month of a taxable year if the benefits are based on the wages and self-employment income of a parent who (1) is entitled to old-age or disability insurance benefits, (2) is aged 67 or older, and (3) has more than $125,000 in earnings for the taxable year (as computed under SSA §203(f)(5)(A)). (Child's insurance benefits provide monthly payments to eligible children of retired, disabled, or deceased workers.) The limitation applies to benefits for months beginning after the date of enactment.
