H.R. 5765 — Affordable, Reliable, Clean Energy Security Act of 2025

This section establishes definitions for purposes of the Act: (1) "affordable" energy as a low-cost method of producing electricity factoring in the full system cost of each generation source; (2) "reliable" energy as a source of electricity with an effective load carrying capability of 60% or greater (except during routine maintenance or repairs), not subject to intermittent availability, and not subject to routine weather impacting production; and (3) "clean" energy as energy generated using sources listed in 42 U.S.C. 15852(b) (i.e., solar, wind, biomass, landfill gas, geothermal, municipal solid waste, or new hydroelectric generation), nuclear reactors, or combustion of hydrocarbons (including natural gas) in accordance with national ambient air quality standards.

This section directs the Secretary of Energy, in coordination with the Secretary of the Interior and the Administrator of the Environmental Protection Agency, to submit to Congress within 90 days of enactment a report identifying regulations, grants, guidance, and policies of their respective agencies relating to affordable energy, reliable energy, and clean energy, and to publish the report on their respective agency websites. The section further directs those officials to update all such regulations, grants, guidance, and policies within 90 days after submitting the report to incorporate the definitions in section 2 of this Act, and to submit to Congress within 180 days of enactment, and publish on their respective agency websites, reports identifying the manner and extent of such incorporation.
