H.R. 5847 — Airline Travelers Right to Know Act

This section establishes chapter 455 of title 49, U.S. Code, concerning toxic fume disclosure on passenger-carrying aircraft operating under part 121 of title 14, Code of Federal Regulations (i.e., commercial air carriers). The chapter requires the Federal Aviation Administration (FAA) Administrator, within 180 days of enactment, to implement a right-to-know policy on potential toxic fume exposure (i.e., from jet engine exhaust, jet fuel, or servicing equipment that may cause acute/chronic impairment, cancer, birth defects, or reproductive harm); the policy must be included in pilot/crew contracts, provided post-ticket purchase, detail safety systems and oxygen therapy, and affirm passengers'/crew's right to use cabin oxygen masks, with civil penalties under 49 U.S.C. §46301 for violations. (1) From enactment, air carriers must require passengers to acknowledge potential toxic fume exposure during ticket purchase/check-in; (2) upon confirmation of toxic fumes, the FAA must immediately notify affected passengers, flight attendants, pilots, and maintenance technicians; (3) air carriers must inform crew of the most recent toxic fume event, its resolution status, and related treatment requests, with crew able to decline assignments on unresolved aircraft without penalty; and (4) civil penalties apply for false statements/misrepresentations causing confirmed illness ($ amount per 49 U.S.C. §46301) or missing reports ($100,000). Additionally, within 15 days of enactment, the Secretary of Transportation must issue regulations requiring installation of toxic fume sensors on such aircraft (with civil penalties), amending FAA civil penalty procedures at 14 C.F.R. §13.18 accordingly, and addressing oxygen for crewmembers. (Thus, the provisions aim to enhance transparency, notification, and mitigation of cabin air contamination risks for passengers and crew.)
