H.R. 5863 — No CDLs for Illegals Act

This section amends federal minimum standards for state issuance of commercial driver's licenses (CDLs) by requiring applicants to present valid documentation proving U.S. citizenship, lawful permanent resident status, or valid work authorization and domicile in the issuing state; prohibits states from issuing CDLs to non-domiciled individuals; and requires states to use the Systematic Alien Verification for Entitlements (SAVE) system (i.e., DHS database) to verify non-citizen applicants' lawful presence and deny licenses if unconfirmed. (As background, CDLs authorize operation of commercial motor vehicles such as large trucks and buses to promote highway safety.) The section further directs the Secretary of Transportation to (1) suspend a state's federal-aid highway apportionments under 23 U.S.C. 104(b) for issuing CDLs in violation of the SAVE requirement, with annual compliance reviews and reinstatement upon certification of corrective action; (2) make a clerical amendment to the chapter analysis for 23 U.S.C. ch. 1; and (3) issue regulations establishing fines for motor carriers that knowingly employ drivers lacking compliant CDLs.
