H.R. 5879 — Save American Democracy Act

This section designates the Act as the “Save American Democracy Act” or the “SAD Act” and states Congress's finding of constitutional authority to establish terms and conditions for states conducting congressional redistricting following House apportionment, pursuant to Article I, section 4, and Fourteenth Amendment section 5.

This section prohibits a state that has redistricted congressional districts after a decennial apportionment under 2 U.S.C. 2a from conducting a subsequent redistricting until after the next apportionment, unless (1) required by a court to comply with the U.S. Constitution, Voting Rights Act of 1965, or state constitution; or (2) expressly required by state legislation implementing the initial redistricting. The prohibition applies to any congressional redistricting after the 2020 decennial census and does not affect state or local elections.
