H.R. 5882 — No Tricks on Treats Act of 2025

This section adds two new misbranding criteria to the Federal Food, Drug, and Cosmetic Act (FD&C Act). It deems a food (other than a dietary supplement) misbranded if it (1) bears or contains any synthetic dye (i.e., a batch-certified dye under 21 CFR part 74 or successor regulations) or added artificial or natural flavoring, unless such fact is prominently stated on the principal display panel; or (2) bears or contains any nonnutritive sweetener, unless such fact is prominently stated on the principal display panel.
