H.R. 5884 — TASK Act

This section excludes from the definition of employee under the Fair Labor Standards Act any individual who performs tasks and services required by a postsecondary vocational institution—as defined in the Higher Education Act of 1965—to obtain a recognized postsecondary credential, as defined in the Workforce Innovation and Opportunity Act. (Thus, such individuals are ineligible for minimum wage, overtime pay, or other employee protections under the Fair Labor Standards Act.)
