This section establishes requirements under the Public Health Service Act for group health plans and group or individual health insurance coverage to enroll qualifying individuals—pregnant women or those who have given birth within the last six months and who are U.S. citizens, nationals, or lawfully present aliens—upon request from an enrolled individual intending (or having already completed) to adopt the qualifying individual's biological child. The request must include signed attestations of adoption intent; coverage is limited to pregnancy-related and postpartum care and mental health and substance use disorder services related to that pregnancy, begins on the first day of the first month after the request is received, and ends on the earliest of (1) notice of termination by the enrollee or qualifying individual, (2) termination of the enrollee's coverage, or (3) one year after the child's birth. A rule of construction specifies that plans and coverage may not require effectuation of the adoption or impose penalties if it does not occur. The requirements apply to plan years beginning on or after January 1, 2026.
