H.R. 5909 — To direct the Secretary of Housing and Urban Development to establish procedures for reporting of condemned Federally assisted rental housing and to authorize penalties related to such condemned housing, and for other purposes.

This section (1) directs the Secretary of Housing and Urban Development (HUD) to establish, not later than six months after enactment, procedures for tenants of federally assisted rental housing to report housing condemned by a city, county, state, or federal agency; (2) authorizes HUD to impose a civil penalty of up to $50,000 on owners of such condemned housing; and (3) defines "federally assisted rental housing" to include dwelling units or projects receiving assistance under programs administered by HUD or USDA—including public housing under the U.S. Housing Act of 1937 (42 U.S.C. 1437 et seq.), Section 8 rental assistance (42 U.S.C. 1437f), supportive housing for the elderly under Section 202 of the Housing Act of 1959 (12 U.S.C. 1701q), and supportive housing for persons with disabilities (42 U.S.C. 8013)—as well as the low-income housing tax credit (26 U.S.C. 42) and specified VA homeless assistance programs.
