H.R. 5912 — DISRUPT Act

This section sets forth congressional findings identifying the People's Republic of China, the Russian Federation, the Islamic Republic of Iran, and the Democratic People's Republic of Korea as foreign adversaries and countries of concern under multiple statutes; describing their deepening bilateral and multilateral cooperation (including treaties, weapons transfers, dual-use technology sharing, joint military exercises, disinformation, and sanctions circumvention) as reinforcing individual threats and challenging U.S. global influence; and noting their alignment in international institutions such as the United Nations and BRICS to erode U.S. power.

This section establishes U.S. policy (1) to disrupt or frustrate the most dangerous aspects of cooperation between China, Russia, Iran, and North Korea—including through sanctions, export controls, public disclosure, and information sharing with allies who share U.S. concerns and have influence over those countries; (2) to constrain that grouping from expanding its global footprint or capabilities; and (3) to prepare for simultaneous challenges or conflicts with multiple such adversaries across theaters by bolstering deterrence.

This section directs the Secretaries of State, Defense, Treasury, and Commerce to each establish a task force on adversary alignment (i.e., cooperation among the People's Republic of China, the Russian Federation, the Islamic Republic of Iran, and the Democratic People's Republic of Korea) not later than 60 days after enactment of this Act, with each task force headed by a designated point of contact and comprising subject matter experts on those adversaries, representatives from all core departmental functions, and a mix of analysts, operators, and senior management with requisite security clearances. Each task force must submit a report to its Secretary and the appropriate congressional committees not later than 180 days after enactment evaluating the impact of adversary alignment on departmental operations and recommending organizational changes to address it; the task force heads must also meet quarterly to discuss findings and next steps. This section further requires (1) the Director of National Intelligence, within 60 days after enactment, to submit a classified report to the President, relevant Cabinet officials, and congressional committees assessing the current nature, five-year trajectory, and risks (e.g., technology transfers, alternate payment systems challenging U.S. dollar dominance and sanctions, conflict assistance among adversaries, and threats to U.S. intelligence) of bilateral and multilateral cooperation among those adversaries, including vulnerabilities and U.S. separation efforts; and (2) the Secretaries of State and Defense, in consultation with the Secretaries of the Treasury and Commerce and the Director of National Intelligence, to submit a report within 180 days after enactment outlining the U.S. strategic approach over the subsequent two years to disrupt adversary cooperation, including available methods and a timeline for diplomatic, intelligence, security cooperation, and foreign assistance tools.
