H.R. 5926 — Mexican Energy Trade Enforcement Act

This section requires the United States Trade Representative (USTR) to either (1) request establishment of a dispute resolution panel with Mexico under Article 31.6 of the United States-Mexico-Canada Agreement (USMCA) regarding covered actions or (2) during the first joint USMCA review, require Mexico to provide non-discriminatory access for United States energy companies consistent with USMCA Chapters 2 (Market Access), 14 (Investment), and 22 (State-Owned Enterprises). It further requires USTR to submit a report to the House Committee on Ways and Means and Senate Committee on Finance within 90 days of enactment detailing actions taken under subsection (a). The section defines covered actions as Mexican measures favoring the state-owned Comisión Federal de Electricidad and Petróleos Mexicanos that formed the basis for U.S. dispute settlement consultations circulated by USTR on July 20, 2022, and that negatively impact U.S. companies operating in Mexico and U.S. energy exports to Mexico.
