H.R. 5929 — Critical Minerals Supply Chain Resiliency Act

This section treats actions taken by the Secretary of Defense pursuant to Presidential Determination 2022–11 (87 Fed. Reg. 19775)—to create, maintain, protect, expand, or restore domestic production of strategic and critical materials under section 303 of the Defense Production Act of 1950 (50 U.S.C. 4533), including through feasibility studies, by-product production, mine waste reclamation, facility modernization, or related activities—as covered projects under the Fixing America’s Surface Transportation Act (42 U.S.C. 4370m(6)), without regard to that definition’s requirements (e.g., $200 million investment threshold or NEPA applicability). Such actions must be included on the Permitting Dashboard (42 U.S.C. 4370m–2(b)), unless the project sponsor requests otherwise. (Covered projects receive coordinated federal environmental reviews and authorizations.)
