H.R. 594 — Detain and Deport Illegal Aliens Who Assault Cops Act

This section revises mandatory detention requirements for certain aliens pending removal proceedings (8 U.S.C. 1226(c)) by (1) replacing "Attorney General" with "Secretary of Homeland Security"; (2) adding as a new detention category any alien who is inadmissible under INA §212(a)(6)(A) (i.e., present without admission or inspection), §212(a)(6)(C) (i.e., fraud or misrepresentation), or §212(a)(7) (i.e., lack of valid entry documents) and who is charged with, arrested for, convicted of, admits having committed, or admits acts constituting an offense involving assault of a law enforcement officer—defined to include firefighters and first responders—while the officer performed official duties, because of such duties, or due to officer status; (3) requiring the Secretary to issue a detainer for and take custody of such aliens if not otherwise detained; and (4) redesignating the prior release provision as paragraph (4). (As background, INA §236(c) requires detention without bond for specified criminal and terrorist aliens upon their release from criminal custody, subject only to narrow witness protection exceptions.)
