H.R. 5955 — BIS License Fee Prohibition Act

This section sets forth congressional findings that (1) Article I, Section 9 of the Constitution states "No Tax or Duty shall be laid on Articles exported from any State"; (2) Section 1756 of the Export Control Reform Act of 2018 (50 U.S.C. 4815) prohibits fees for submission, processing, or consideration of export license applications and related requests; and (3) export controls on dual-use technologies to the People's Republic of China should be based on national security and economic competitiveness assessments.

This section prohibits the federal government from collecting fees, revenue-sharing, or other monetary arrangements conditioned on export licenses or authorizations under the Export Control Reform Act of 2018 (ECRA) after enactment of this Act. It requires the Secretary of Commerce to refund all such previously collected amounts to license holders within 30 days, limits use of those funds solely to refunds, and clarifies that the provision does not authorize semiconductor export fees or deem them consistent with the Constitution or ECRA requirements (50 U.S.C. 4815).
