H.R. 5960 — Territorial De Minimis Exemption Act

This section exempts articles originating from the U.S. Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa from the elimination of de minimis treatment (i.e., duty- and tax-free entry), allowing such articles imported by one person on one day with an aggregate fair retail value not exceeding $800 to enter the U.S. customs territory free of duty and tax on and after enactment. It prohibits splitting shipments to claim the exemption and directs the Secretary of the Treasury to issue regulations implementing the privilege in the same manner as before January 1, 2025.

This section directs the President, when making determinations on changes to U.S. trade policy—particularly those with global or widely applicable effects—to consult as appropriate with the Secretaries of the Interior and Commerce and, to the maximum extent practicable, ensure that such changes do not adversely affect commerce in U.S. territories (e.g., by treating articles originating from those territories as imports from foreign countries).
