H.R. 6035 — Second Amendment Restoration Act of 2025

This section states congressional findings that (1) the Second Amendment guarantees law-abiding citizens' right to keep and bear arms, (2) the firearm-related provisions of the Bipartisan Safer Communities Act (Public Law 117-159) impose unnecessary burdens on that right without demonstrable public safety benefits, and (3) the purpose of this Act is to restore constitutional protections and refocus federal efforts on addressing the root causes of violence.

This section repeals (1) Title II of division A (firearms provisions) and (2) Subtitle D of title III of division A (amendments to the Elementary and Secondary Education Act of 1965) of the Bipartisan Safer Communities Act (P.L. 117-159); restores provisions amended by Title II—including in 18 U.S.C. §§921, 922, 924, 1956, 1961, and 2516; section 103 of the Brady Handgun Violence Prevention Act (34 U.S.C. §40901); section 501 of the Omnibus Crime Control and Safe Streets Act of 1968 (34 U.S.C. §10152); and 28 U.S.C. §534—to their pre-enactment text; strikes items relating to sections 932, 933, and 934 from the table of sections for 18 U.S.C. chapter 44 (added by Title II to address firearms trafficking, safe storage, and dealer inspections); restores pre-enactment text to section 8526 of the ESEA (20 U.S.C. §7906); and strikes appropriated funding for grants to states to provide disqualifying juvenile records to the National Instant Criminal Background Check System (NICS). (Thus, Title II's expansions of NICS background checks—including enhanced checks for prospective purchasers under age 21 and closure of the "boyfriend loophole" for misdemeanor domestic violence offenders—dealer recordkeeping requirements, and new offenses are eliminated.)
