H.R. 6086 — Aviation Funding Solvency Act

This section establishes temporary authority, notwithstanding 49 U.S.C. 44307, to use covered amounts (i.e., balance in the Aviation Insurance Revolving Fund minus $1 billion) for Federal Aviation Administration (FAA) programs, projects, and activities—including Operations and Facilities and Equipment accounts—during a lapse in appropriations. (The Aviation Insurance Revolving Fund is a revolving fund that finances government-provided aviation insurance when commercial coverage is unavailable, such as during war or national emergency.) Funds are available at the preceding fiscal year's rate for operations (per the prior appropriation act or continuing resolution), from the first day of the lapse until a new regular appropriation or continuing resolution becomes law (with authority extending into the next fiscal year if needed); are subject to the prior year's terms and conditions; and, once enacted, are charged against subsequent appropriations. If covered amounts are insufficient, the FAA Administrator must prioritize compensation for Air Traffic Organization employees. This authority does not apply if another law provides or prohibits funding for the activity or if using it would reduce the fund balance below $1 billion.
