H.R. 6116 — Safe Hydration is an American Right in Energy Development Act of 2025

This section amends the minimum requirements for state underground injection control (UIC) programs under the Safe Drinking Water Act—designed to prevent underground injection that endangers underground sources of drinking water (USDW)—by adding a new subparagraph (E) to Section 1421(b)(1) that prohibits the underground injection of fluids or propping agents pursuant to hydraulic fracturing operations related to oil, gas, or geothermal production unless the operator agrees to conduct testing and reporting in accordance with new Section 1421A. Section 1421A requires operators to test accessible USDW (1) at all sites within a 0.5-mile radius of the operations (or the nearest within 1 mile if none closer), using EPA-certified labs for substances indicating fracking-related damage; (2) on schedules varying by site status as of enactment—prior to new or renewed injection, every 6 months during operations, and every 12 months for 5 years post-cessation (or every 6 months from enactment for ongoing sites until cessation, then every 12 months for 5 years); and (3) to report results to EPA within 2 weeks, with an exception if no accessible USDW exists within 1 mile. Section 1421A further directs EPA to establish a publicly accessible, ZIP Code-searchable database of test results and defines "accessible underground source of drinking water." This section also makes a conforming amendment to Section 1421(d)(1)(B)(ii) to except fracking injections from a prior regulatory exemption insofar as they are subject to the new requirements.
