H.R. 6135 — Snap Delivery Modernization Act of 2025

This section amends the Food and Nutrition Act of 2008, which authorizes the Supplemental Nutrition Assistance Program (SNAP) to provide food purchase benefits to low-income households via EBT cards redeemable at authorized retailers (including for online and delivered orders), (1) by adding a definition of “delivery platform or delivery services provider” as an entity that facilitates the online sale or delivery, or both, of food from a retail food store or delivers food purchased from such a store (including via first- or third-party services); (2) by revising exclusions from household income for certain third-party vendor payments under section 3(o)(5)—(A) simplifying subparagraph (B) by striking language referencing delivery orders and (B) excluding delivery fees from subparagraph (C); and (3) by excluding delivery fees charged by retail food stores or delivery platforms or services from allowable EBT charges to SNAP households under section 7(k). (Thus, SNAP benefits cover only the cost of eligible food, not associated delivery fees.)
