H.R. 6139 — Union Members Right to Know Act

This section amends section 104 of the Labor-Management Reporting and Disclosure Act of 1959 (LMRDA) by designating the existing text—requiring labor organization officers to provide copies of collective bargaining agreements (CBAs) to affected employees upon request and to maintain such copies for inspection—as subsection (a) and by adding subsection (b). Subsection (b) requires the secretary or principal officer of each labor organization, not later than 18 months after enactment of the Union Members Right to Know Act and annually thereafter, to either (1) provide copies of each in-effect CBA to directly affected employees or (2) post and maintain all such CBAs on the union's website. (Thus, unions must proactively distribute CBAs rather than only upon request.) It further amends section 105 of the LMRDA by designating the existing text—requiring unions to make available to members copies of the LMRDA, the union's constitution and bylaws, and officers' annual financial reports—as subsection (a) and by adding subsection (b). New subsection (b) requires each labor organization to provide to members, by mail or email, (1) a copy of the LMRDA and a summary of each title and (2) the union's constitution and bylaws as follows: (A) to members joining on or after 90 days post-enactment, within 30 days of joining; and (B) to all members, within one year post-enactment and annually thereafter. If the union has a website, it must maintain on the homepage a hyperlink titled "Union Member Rights and Officer Responsibilities Under the LMRDA" to such information, with certifications of initial compliance due to the Secretary within 180 days post-enactment and annual compliance certifications due beginning 18 months post-enactment.
