This section amends the Federal Arbitration Act (Title 9, U.S. Code) by adding chapter 5, which declares predispute arbitration agreements and predispute joint-action waivers invalid and unenforceable—at the election of the claimant or class/collective representative—with respect to race discrimination disputes (i.e., disputes alleging discrimination, including harassment, or retaliation on the basis of race, color, or national origin under federal, tribal, state, or local law). (Thus, such disputes may proceed in court, including as class or collective actions.) Courts determine the chapter's applicability under federal law, rather than arbitrators, irrespective of any delegation in the agreement. The section makes conforming amendments to §§2, 208, and 307 and the table of chapters.
