H.R. 618 — Apex Area Technical Corrections Act

This section amends the Apex Project, Nevada Land Transfer and Authorization Act of 1989 (P.L. 101-67), which authorizes the transfer of federal lands in the Apex area near Las Vegas, Nevada, to Clark County for industrial development and site remediation, as follows: (1) defines "Apex Industrial Park Owners Association" (as chartered on April 9, 2001, with the Nevada Secretary of State) and "City of North Las Vegas"; (2) expands eligibility for utility rights-of-way connections from Clark County to include the City of North Las Vegas and Apex Industrial Park Owners Association, for the Kerr-McGee Site and other conveyed lands (and adds successor maps to the May 1989 maps); (3) conditions rights-of-way grants under section 4(c) on compliance with section 6 and applicable law, and expands recipients to Clark County, the City of North Las Vegas, and Apex Industrial Park Owners Association; (4) extends the section 4(e)(1) mineral withdrawal in perpetuity for all lands transferred under that subsection; (5) adds section 4(e)(3) authorizing noncompetitive sales of mineral materials from surface activities (e.g., grading) on parcels where the United States retains mineral interests, deeming competition impracticable under 43 C.F.R. § 3602.31(a)(2) and exempting such sales from subpart 3602 quantity and term limits (as in effect on enactment); and (6) adds section 6(d) conditioning additional land transfers or rights-of-way on compliance with the National Environmental Policy Act of 1969 and Federal Land Policy and Management Act of 1976.
