H.R. 6253 — Algorithmic Transparency and Choice Act

This section requires providers of a covered online platform (i.e., an online platform that uses a personalized recommendation system) to provide covered users (i.e., minors who register an account or create a profile on the platform), beginning one year after enactment, with (1) a clear and conspicuous notice of the personalized recommendation system upon first interaction; (2) a detailed notice in the platform's terms and conditions describing the system's features, user-specific data used, opt-out and modification options, and optimization quantities; (3) an option to switch to an input-transparent algorithm (i.e., a fully automated system that does not use user-specific data unless expressly provided by the user); and (4) an option to limit recommendation types or categories, with the input-transparent algorithm as the default setting. This section treats violations as a violation of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (15 U.S.C. 57a(a)(1)(B)), enforceable by the Federal Trade Commission using all applicable powers, penalties, privileges, and immunities under that Act, without requiring disclosure of proprietary, privileged, or confidential information or limiting platforms' ability to restrict user interactions at a covered user's direction.
