H.R. 6259 — No Fentanyl on Social Media Act

This section directs the Federal Trade Commission (FTC), in coordination with the Secretary of Health and Human Services (acting through the Food and Drug Administration Commissioner) and the Drug Enforcement Administration Administrator, to submit to the House Committee on Energy and Commerce and the Senate Committee on Commerce, Science, and Transportation—and publicly post on the FTC website—not later than one year after enactment of this Act—a report on minors' ability to access fentanyl (including analogues, fentanyl-related substances as defined in 21 U.S.C. 812(c) Schedule I(e), and pressed pills) via social media platforms. The report must assess (1) the prevalence and ability of minors to access fentanyl from drug sellers on such platforms; (2) the resulting health and physical safety risks to minors; (3) drug sellers' use of platforms to market, sell, deliver, distribute, dispense, or transact fentanyl to minors; (4) how platform design features enable such access; (5) platforms' practices, policies, and measures to counter it and their effectiveness; (6) other measures by law enforcement, the medical community, and others; and (7) recommendations for Congress. In developing the report, the FTC must consult stakeholders including parents, platforms, law enforcement, and medical professionals and, with Attorney General input, may redact law enforcement-sensitive information from specified elements prior to public release. The section defines "minor" as under age 18 and "social media platform" as a public-facing website or app primarily hosting user-generated content (excluding email and broadband providers).
