§2. United States Victims of State Sponsored Terrorism Fund payments for Havlish Settling Judgment Creditors
This section amends the Justice for United States Victims of State Sponsored Terrorism Act to establish an exception in subsection (e)(2)(B) of the United States Victims of State Sponsored Terrorism Fund statute (i.e., the USVSST Fund, which compensates U.S. victims of state-sponsored terrorism, including 9/11 claimants) for "Havlish Settling Judgment Creditors"—defined in new subsection (j)(17) as certain 9/11 claimants identified as settling judgment creditors in a 2014 court order in In re 650 Fifth Avenue (S.D.N.Y.). The exception (1) exempts such creditors who previously elected Fund participation or applied for conditional payment, and their assets or proceeds, from the restrictions of subsection (e)(2)(B); (2) directs release and payment of their previously withheld escrowed funds; and (3) preserves their eligibility for future payment rounds on the same terms as other eligible claimants under subsection (j)(10)-(14). The amendments apply as if enacted on December 29, 2022.
