H.R. 6265 — Safer GAMING Act

This section requires online video game providers to implement safeguards enabling parents of known minor users (i.e., covered users) of interactive online video games (i.e., internet-connected video games allowing user-to-user communication) to limit the minor's communications with other users, including adults. These safeguards must be accessible and easy-to-use, enabled by default on the minor's account, and disableable only by the parent; additionally, the most protective privacy and safety settings must include the safeguards by default for minors (with parent-only disablement) and take effect one year after enactment. This section treats violations as unfair or deceptive acts under FTC rules (15 U.S.C. 57a(a)(1)(B)), authorizing the Federal Trade Commission to enforce them using its full powers under the FTC Act (15 U.S.C. 41 et seq.). It further authorizes state attorneys general to bring civil enforcement actions on behalf of state residents (with prior notice to the FTC, which may intervene), while preserving the FTC's other authorities.
