H.R. 627 — Ensuring Accurate and Complete Abortion Data Reporting Act of 2025

This section states congressional findings on voluntary abortion data reporting to the Centers for Disease Control and Prevention (CDC), including that (1) past voluntary reporting has resulted in incomplete data; (2) states vary greatly in data collected and published despite CDC requests; (3) no single abortion data point is publicly reported for all 50 states and the District of Columbia; (4) three states accounting for 15% of U.S. women of childbearing age report no data; and (5) accurate data on abortions and survivors is critical to public health and policy analysis.

This section conditions Medicaid payments at 90% federal matching for family planning services and supplies (i.e., under SSA sec. 1903(a)(5), for services described in sec. 1905(a)(4)(C) furnished to individuals eligible solely for family planning under sec. 1902(ii) or a sec. 1115 waiver) on states submitting specified abortion data to the CDC's abortion surveillance system. Beginning with the year two years after enactment, states must submit by December 31 of the previous year the prior year's data on mandatory questions under PHS Act sec. 317W(a)(3)(A) and certify its accuracy; late submission by December 31 of the current year preserves payments (including retroactively), but a determination of knowingly false data withholds such payments for the first full fiscal year following.

This section directs the CDC to establish and maintain a surveillance system to collect aggregate data on abortions in the United States from states (including the District of Columbia and territories) using a standard worksheet with mandatory questions on 10 specified variables—(1) maternal age, (2) gestational age in completed weeks, (3) maternal race, (4) maternal ethnicity, (5) maternal race by ethnicity, (6) abortion method type, (7) maternal marital status, (8) previous pregnancies (live births, induced abortions, and spontaneous abortions), (9) maternal residence (state or county), and (10) whether the child survived the abortion—which are tied to Medicaid funding reductions under SSA §1903(cc) for non-reporting. The section further requires the CDC to (1) allow cross-tabulation of key variables (e.g., maternal age by gestational age, race/ethnicity by gestational age), (2) permit additional voluntary questions, (3) provide technical assistance to states, (4) periodically update the worksheet, and (5) publish annual abortion reports by December 30 of the third calendar year following the covered year.
