H.R. 6271 — Food Bank Emergency Support Act of 2025

This section appropriates $462.5 million for the Emergency Food Assistance Program (TEFAP) under section 27 of the Food and Nutrition Act of 2008 (7 U.S.C. 2036), to remain available until expended. The funds become available if (1) appropriated funds for the Food and Nutrition Act of 2008 (i.e., Supplemental Nutrition Assistance Program or SNAP) are insufficient to maintain benefit levels without reductions, or (2) the Secretary of Agriculture determines or certifies that available budget authority is insufficient for full, timely SNAP benefit payments to all eligible households—including during and after lapses in appropriations. This section deems all services performed by officers, employees, or contractors to carry out TEFAP (including commodity distribution orders) as emergencies involving the safety of human life or the protection of property for purposes of the Antideficiency Act (31 U.S.C. 1342). (Thus, such personnel are excepted from furlough during lapses in appropriations.)
