H.R. 6292 — Don’t Sell Kids’ Data Act of 2025

This section prohibits data brokers from collecting, using, maintaining, selling, licensing, or otherwise making available personal data of known children or teens, except as necessary to comply with the prohibition or data deletion requirements. It requires data brokers to delete all such existing data; establish a public mechanism (e.g., website notice) for deletion requests from teens, parents or legal guardians of children, or their agents; and process requests within 10 days by identifying, deleting the data, and notifying the requester. It treats violations as unfair or deceptive acts or practices under FTC Act section 18(a)(1)(B) (15 U.S.C. 57a(a)(1)(B)), enforceable by the FTC with full powers, privileges, and immunities under the FTC Act (15 U.S.C. 41 et seq.); authorizes state attorneys general to bring parens patriae civil actions for injunctions, compliance, damages, restitution, or other relief (with prior notice to the FTC, which may intervene, and no state action if a parallel federal case is pending); and preserves other state investigative authorities and ongoing proceedings.
