H.R. 6302 — Whistleblowers Aiding National Security Act of 2025

This section establishes a Defense Exports Control Whistleblower Incentive Program within the State Department Basic Authorities Act of 1956. The Secretary of State must issue an interim rule within 120 days of enactment and a final rule within 270 days; develop a secure public online portal for submissions within 120 days; and publish notice of the program in the Federal Register upon portal establishment. The program authorizes awards of 10 to 30 percent of any civil penalty imposed for a covered violation based on original information voluntarily provided by a whistleblower. Awards consider the information's significance, assistance provided, and factors such as accuracy, relevance, timeliness, and usefulness; joint submissions are split equally among submitters. The Secretary must assess information credibility within 60 days, complete investigations (if credible) within 180 days, and provide status updates at least every 30 days. Awards are denied if information was obtained through certain compliance or audit roles (with exceptions) or illegally; anonymous submissions are permitted, with possible identity disclosure before payment, and counsel representation is allowed. Frivolous submissions (two or more prior non-credible reports) may be dismissed without review. (Thus, the program incentivizes reporting of defense export control violations to enhance enforcement of arms export regulations administered by the State Department's Directorate of Defense Trade Controls.)
